Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Mest websites, including https://mest.io and all other subdomains, (the "Service") operated by Mest Pte. Ltd. ("us", "we", or "our"), a company incorporated in Singapore.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

To the maximum extent permitted under applicable law, the Service is provided on an “as is” and “as available” basis. We expressly disclaim, and you waive, all warranties of any kind, whether express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement as to the Service, including the information, content and materials contained therein.

The Service is a social platform which means users can see and interact with each other’s creations on the Service. Users must be aware that everything they create (including but not limited to widgets, stories, and more) with the Service, will be publicly accessible for all other users and the public in general.

ACCEPTABLE USE

You undertake that you will use the Service in accordance with applicable law and regulations, and in accordance with these Terms of Use.‍ You must not modify, adapt, or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Mest PTD, LTD., or any other Mest service. You agree not to reproduce, duplicate, copy, sell, resell or in any other way exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Mest. You must not upload, post, host, or transmit unsolicited emails, SMS, or "spam" messages.

You are responsible for ensuring that the information you post and the content you share does not;

• contain false, misleading or otherwise erroneous information

• infringe someone else’s copyrights or other intellectual property rights

• contain sensitive personal data or

• contain information that might be received as offensive or insulting.

Such information may be removed without prior notice.

When information obtained through the use of the Service is shared, presented or utilized in any way outside of the Service, the user is required to reference Mest as its source and include a direct link to the relevant widget/widgets and/or story/stories.‍ Mest reserves the right to at any time determine whether a use of the Service is in violation of its requirements for acceptable use.

Violation of the at any time applicable requirements for acceptable use may result in termination of your account. We will take reasonable steps to notify you and state the reason for termination in such cases.

ACCESSING MEST USING WEB3 SERVICES:

Mest leverages web3 services to provide our end-users with the ability to sign up with, or associate their existing account, to their blockchain address which functions as an extension of their personal identity and can be used as a form of accessing the platform.

By using this feature Mest assumes the right to collect your blockchain wallet address, completed transaction information and token identifiers for the purpose of enabling this feature.

Wallets are not maintained by, operated by, or affiliated with Mest. Mest has no control over the contents of your wallet and does not accept any responsibility for, or liability to you, in connection with your usage of a wallet on the Mest platform. You, as the user and owner of the wallet, are solely responsible for keeping your wallet secure. You should never share credentials or seed phrases of your wallet with anyone and Mest will never ask for this information under any circumstances. Any issues noted with your wallet, should be directed to and discussed with your wallet provider.

THIRD-PARTY SERVICES

‍‍To the extent the Service facilitates access to services provided by a third party, you agree to comply with the terms governing such third party services. Mest shall not be held liable for any errors, omissions, inaccuracies, etc. related to such third-party services.

INTELLECTUAL PROPERTY RIGHTS

We retain all rights, including all copyright and other intellectual property rights, in all content and other materials contained on our website or provided in connection with the Service.

‍You receive no license or usage rights to the Service other than what is explicitly stated in these Terms.

LIMITATION

Except as otherwise required by law, in no event shall we be liable for any special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, arising out of or in any way connected with the use of or inability to use the Service, including without limitation any damages resulting from reliance by you on any information obtained from using the Service.

MAINTENANCE

We may temporarily suspend the Service from time to time for maintenance. We do not warrant any particular level of Service availability.

TERMINATION

We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

At our sole discretion, we reserve the right to modify or replace these Terms at any time. If a revision is a material we will try to notify you prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

You irrevocably agree that the Singapore courts shall have non-exclusive jurisdiction to hear and decide any suit, action or proceedings or settle any dispute arising out of or in connection with the Service.
